1. 适用

位于香港的新世界发展有限公司（以下简称“新世界”、“本公司”、“我们”或“本公司的”）是属于新世界集团公司的一部分，新世界集团公司包括新世界发展有限公司及其在香港不时成立及存续的关联公司或相关公司（如此处所列: https://nwd.com.hk/pics/）（“新世界集团”或”NWG”）致力于保护我们业务所在地区的个人信息。

 

如果您是：

 

1.                  位于中国内地的个人，于中国内地访问新世界相关海上游乐场网站或从中国内地通过手机或任何其他方式使用或出席現於海上游乐场、新世界的場地、設施、活動、項目、产品及/或服务；及/或
2.                 持有中国内地护照及/或居民身份证的个人，使用或出席海上游乐场、新世界的場地、設施、活動、項目或在香港通过手机或任何其他方式使用新世界产品及/或服务，

 

我们将根据本附录、新世界集团私隐政策声明（“私隐政策”）、个人资料收集声明（“个人资料收集声明”）以及中国内地适用的数据保护法律法规处理您的个人信息。

 

因此，在使用使用或出席海上游乐场、新世界的場地、設施、活動、項目、产品及/或服务或向我们提供任何个人信息之前，请确保您已仔细阅读、理解并同意个人资料收集声明、私隐政策和本附录。

 

就本附录目的而言，“中国内地”是指中华人民共和国除香港特别行政区（“香港”）、澳门特别行政区和台湾以外的地区。除非另有定义，本附录中的词汇应与私隐政策和个人资料收集声明中的所定义者具有相同的含义。

 

如有任何冲突或不一致之处，应按以下顺序解决（从高到低）：-（a）本附录；（b）; 个人资料收集声明及（c）私隐政策。

 

2. 个人信息

 

在本附录中，“个人信息”是指以电子或者其他方式记录的与已识别或者可识别的自然人有关的各种信息，不包括匿名化处理后的信息。本附录中涉及的个人信息包括私隐政策第5条中列明的内容。

 

此外，“敏感个人信息”是指一旦泄露或者非法使用，容易导致自然人的人格尊严受到侵害或者人身、财产安全受到危害的“个人信息”。私隐政策和本附录中涉及的“敏感个人信息”包括住宅地址、婚姻状况、日志文件、跟踪数据、在应用程式及/或网站（视情况而定）的 交易情况（包括您的特点和交易行为）以及由我们、我们的相关关联公司及/或营销合作伙伴（如适用，视情况而定）运营的相关会员/奖赏计划下与您的账户有关的交易及/或活动记录。

 

“处理”或对“个人信息”的“处理”包括对“个人信息”的收集、存储、使用、加工、传输、提供、公开、删除等。

 

3. 我们如何收集和处理您的个人信息

 

除私隐政策第5条和第6条中的内容以外，以下内容也适用于我们如何收集和处理您的个人信息：-

 

1.      新世界将为下文进一步说明的目的以及相关个人资料收集声明中列明的目的（“目的”）处理您的个人信息。当中，为了使我们能够实现这些目的并向您提供相应的产品/服务，以下列出的个人信息（包括敏感个人信息）是必要的。如果这些信息无法提供或不准确，我们可能无法向您提供相应的产品/服务：-

 

 

2.      一般情况下，我们会在征得您的同意后处理您的个人信息，并在适当的情况下，在中国内地适用的数据保护法律法规要求的特定情况下征得您的单独同意后处理您的个人信息。您认可并同意在以下情况下，我们无需获得您的同意即可处理您的个人信息：-

 

(i) 该等处理为订立或履行您作为一方的合同所必须，或者按照依法制定的劳动规章制度和依法签订的集体合同实施人力资源管理所必须；

(ii) 该等处理为履行我们在任何适用法律法规下的责任或义务所必须，包括与以下直接相关的：

1.        国家安全和国防；
2.        刑事调查、起诉和审判以及执行法院命令、判决或相关事项；或
3.         公共安全、公共卫生或重大公共利益；

(iii) 该等处理为应对突发公共卫生事件，或者紧急情况下为保护自然人的生命、健康和财产安全所必须；

(iv) 为实施新闻报道、舆论监督以及其他合乎公共利益的活动，在合理的范围内处理个人信息；

(v) 依照法律法规在合理的范围内处理您自行公开或者来自公共来源的关于您的个人信息；或

(vi) 法律法规规定的其他情形。

 

4. 您作为个人信息主体的权利

 

1.      请参阅私隐政策第15条中有关您查阅、改正您的个人信息及撤销同意的权利。此外，根据中国内地适用的数据保护法律法规，我们将确保您可以对您的个人信息行使以下权利，包括：-

 

1.      在下列情况下，您可以要求删除您的个人信息：-

（1）我们对您的个人信息的处理违反了适用的法律或法规；

（2）我们在缺乏您同意的情况下收集或使用您的个人信息；

（3）我们对您的个人信息的处理违反了我们与您的协议；

（4）您不再使用我们的产品及/或服务，或本附录第3条中所述的目的已经实现或完成；

（5）您撤回您的同意；

（6）我们不再向您提供产品及/或服务；

 

2.      更改您的同意范围；
3.      获取您的个人信息的副本；或
4.      在遵守适用的法律法规的前提下，要求将您的个人信息转移给另一个个人信息处理者。

 

2.      该等要求应通过私隐政策第19条中的联系方式向新世界的个人资料私隐主任（地址：香港特别行政区中环皇后大道中 18 号新世界大厦 30 楼）（标记为机密）提出。我们将尽力在收到您的要求后的15个中国内地工作日内答复您有关上述内容的合理要求。

 

3.      但是，请注意我们可能会在下列情况下拒绝您的请求：-

 

1.      与我们履行法律法规的义务相关的情况，包括我们向中国内地法律法规规定的监管机构及/或其他政府部门提供您与我们之间的交易过程中产生的您的个人信息（包括您的敏感个人信息）；
2.      任何法律或行政法规规定的数据保留期限未届满，或者删除个人信息从技术上难以实现的（在这种情况下，我们将采取必要的安全保护措施，以确保您的个人信息的安全，或将该等个人信息匿名化）；
3.      与国家安全和国防安全直接相关的情况；
4.      与公共安全、公共卫生或重大公共利益直接相关的情况；
5.      与刑事调查、起诉和审判以及执行法院决定直接相关的情况；
6.        我们有足够的证据证明您有主观恶意，或者您在滥用权利的情况；
7.      涉及保护您或他人的生命、财产和其他重要合法权利的情况；
8.      对您的请求作出回应将对您或其他个人或组织（包括我们）的合法权利及权益造成严重损害的情况；
9.         涉及商业秘密的情况。

 

5. 个人信息的保留

 

我们保留您的个人信息的时间不会超过为实现目的所必需的时间。请参阅私隐政策中第8条，以了解更多详情。

 

6. 我们如何委托他人处理、分享、转移和公开披露您的个人信息

 

 

1.      为实现本附录第3条规定的目的，您理解并同意，我们可以按照私隐政策第9和第11条的规定，委托第三方服务商处理您的个人信息（包括敏感个人信息）。

 

2.      我们委托的第三方服务商无权将您的个人信息用于任何其他目的。如果您的个人信息的处理目的有任何变更，我们将再次征得您的同意。

 

3.      您的个人信息也可能与位于香港境内或境外的新世界集团及合营公司（统称“关联公司”）及我们的“营销合作伙伴”分享，其中包括房地产开发商、银行、金融和投资机构、保险公司、私人俱乐部、礼宾和客服提供商、零售商店及网上商店（产品和服务包括时尚服饰和美容、健康和个人护理、奢侈品、家居生活、食品、酒水饮料、书籍和文具）、购物中心、奖赏计划、百货公司、钟表和珠宝商（如周大福珠宝集团有限公司）、连锁酒店、餐饮服务提供商、医疗保健和长者护理、其他服务及/或产品提供商，包括健康和保健、艺术和文化、画廊和展览、环保和自然、体育和娱乐、旅游和住宿、休闲和娱乐、运输和物流、电讯、媒体和资讯科技、企业创新、加速器和孵化计划、竞赛、会议和活动、学前、小学、中学及/或高等教育机构等。具体内容见本附录的附件1。

 

7. 我们如何存储和转移您的个人信息

 

原则上，我们根据本附录第3条列出的商业目的在中国境内收集、提供和处理个人信息，并将其储存在中国香港。您理解、授权并同意，因业务需要及只为达到本附录第3条所列的业务目的，并在法律允许的最大范围内和根据中国法律法规的强制性规定，我们可以将您的个人信息从中国内地转移至我们在香港的总部、在中国内地境外的关联公司、营销合作伙伴和其他实体（详情请参阅本附录附件2），以及受我们委托处理您的个人信息的合作伙伴、合作者、代理、承包商、供应商及服务提供商，在中国内地和香港的伺服器及/或数据中心（详情请参阅本附录附件3）]可从获取您的个人信息。中国内地和香港已经制定了个人信息保护法律，我们也将确保您的个人信息按照本政策得到充分的保护。如果您想进一步了解您的个人信息的存储和跨境转移，撤回您的同意及/或根据本附录第4条行使您的其他权利，请通过本附录第10条列出的方式与我们联系，我们将在合理范围内回应您的要求。

 

我们不会将您的个人信息转移给新世界集团、其关联公司及/或营销合作伙伴之外的任何公司、组织或个人，但以下情况除外：

 

（1） 经单独同意的转移。在获得您的单独同意后，我们将根据本附录将您的个人信息转移给其他各方；

 

（2） 当我们参与任何实际或拟议的业务转让、股份转让、重组、合并、并购、出售、转让或购买我们、我们的业务、我们的关联公司或我们的关联公司的业务时（请参阅私隐政策第18条）；

 

（3） 我们可能会根据适用的法律和法规、诉讼程序的要求、强制性的行政或司法要求，在其他情况下转移您的个人信息。

 

8. 我们如何处理未成年人的个人信息

 

有关如何处理未成年人的个人信息，请参阅附件A。如果父母或法定监护人意识到其照顾的未满十八（18）周岁未成年人的个人信息在未经其同意的情况下被提供给我们，请立即通知我们删除该等个人信息。

 

9. 其他

 

此外，私隐政策中的以下条款将适用：-

 

1.      第4条应适用于cookies的使用和其他跟踪机制；
2.      第12条应适用于个人信息的保安；
3.      第13条应适用于新世界豁免有关披露您的个人信息的责任的情况，这将受制于中国内地适用的法律法规；
4.      第17条应适用于私隐政策和本附录的更新。

1. 适用

 

本附件A列出了新世界发展有限公司在处理18周岁以下并符合以下条件的人士（该等18周岁以下个人统称为“未成年人”）的个人信息时的规则：

 

1.                  位于中国内地的个人，于中国内地访问新世界相关海上游乐场网站或从中国内地通过手机或任何其他方式使用或出席現於海上游乐场、新世界的場地、設施、活動、項目、产品及/或服务；及/或

 

2.                 持有中国内地居民护照及/或身份证的个人，使用或出席海上游乐场、新世界的場地、設施、活動、項目或在香港通过手机或任何其他方式使用新世界产品及/或服务。

附录第5条适用于处理未成年人个人信息的目的，而除因本附件A第3条的目的而收集及处理未成年人的个人信息外，未成年人的个人信息不会被储存在我们的系统内并在完成该等目的后会被删除。

 

此外，我们严格控制对未成年人个人信息的访问，并只允许必须处理未成年人的个人信息的授权人员访问这些数据。

 

6. 我们如何委托他人处理、分享、转移和公开披露未成年人的个人信息

 

1.   为实现列于本附件A第3条处理未成年人个人信息的目的，我们可能会委托《个人资料收集声明》所列的代理人、外判商、第三方服务商、供应商、公营及政府机构、专业顾问及/或其他服务提供方，仅就处理未成年人个人信息的目的处理该等个人信息，包括但不限于身份认证。

 

2.   我们所委托的代理人、外判商、第三方服务商、供应商及/或其他服务提供方无权使用未成年人的个人信息作其他目的。如果使用未成年人的个人信息的目的有改变，我们就将向您重新征得同意。

 

3.    我们并无将未成年人的个人信息转移。

 

 

7. 我们如何存储及转移未成年人的个人信息

 

未成年人的个人信息将不会存储至活動后且不会转移至任何第三方。

1. Application

New World Development Company Limited in Hong Kong (“NWD”, “we”, “us” or “our”) is part of New World group of companies including New World Development Company Limited and its affiliated or related companies from time to time in Hong Kong (as listed here: https://nwd.com.hk/pics/) (the “New World Group” or “NWG”) is committed to protecting personal data of individuals in territories where we do business. 

 

If you are:

 

1.                  an individual located in Mainland China who visits NWD’s relevant website(s) for the Playpark , or otherwise uses or attends the Playpark, NWD’s premises, facilities, events, programmes products and/or services by phone or any other means from Mainland China; and/or
2.                 an individual holding a Mainland China passport and/or resident identity card who visits, uses or attends the Playpark, NWD’s premises, facilities, events, programmes in Hong Kong or otherwise use NWD’s products and/or services by phone or any other means in Hong Kong,

 

your personal data will be processed by NWD in relation to the Carnvial in accordance with this Addendum in addition to the New World Group Privacy Policy Statement (“Privacy Policy Statement”), and the Personal Information Collection Statement (“PICS”), as well as the applicable data protection laws and regulations in Mainland China.  

 

Therefore, before visiting, using or attending the Playpark, NWD’s premises, facilities, events, programmes or using our products and/or services or providing any personal data to us, please ensure that you have carefully read, understood and agree to the PICS, the Privacy Policy Statement and this Addendum. 

 

For the purpose of this Addendum, “Mainland China” refers to the People’s Republic of China excluding the Hong Kong Special Administrative Region of the People’s Republic of China (“Hong Kong”), the Macau Special Administrative Region of the People’s Republic of China and Taiwan. Unless defined otherwise, all defined terms (capitalised terms) in this Addendum shall have the same meaning as the defined terms in the Privacy Policy Statement and PICS.        

 

In the event of any conflict or inconsistency, they shall be resolved in the following order of precedence (from higher to lower) in respect of such conflict or inconsistency: - (a) this Addendum; (b) the PICS and (c) the Privacy Policy Statement.

 

2. Personal data

 

In this Addendum, “personal data” refers to various information related to an identified or identifiable natural person recorded electronically or by other means and does not include anonymized information. Personal data involved in this Addendum includes those set out in Clause 5 of the Privacy Policy Statement.

 

In addition, “sensitive personal data” refers to “personal data” that, once leaked or illegally used, may easily lead to violation of the personal dignity of a natural person or harm of personal or property safety. The “sensitive personal data” involved in the Privacy Policy Statement and this Addendum includes residential address, marital status, Log Files, Tracking Data, transaction information (including your characteristics and transaction behavior on the Application and/or the Website (as the case may be)) and the relevant transactional and/or activity records under or relating to your account(s) with the relevant club(s)/loyalty programme(s) operated by us, our relevant Affiliates and/or relevant Marketing Partners (if applicable, as the case may be).

 

“Process” or “processing” of “personal data” includes the collection, storage, use, processing, transmission, provision, disclosure, deletion, etc. of “personal data”.

 

3. How we collect and process your personal data

 

Apart from Clauses 5 and 6 of the Privacy Policy Statement, the following also applies to how we collect and process your personal data:-

 

1.      Your personal data will be processed by NWD for the purposes as further specified below and set out in the relevant PICS (“Purposes”). In particular, for us to carry out the Purposes and provide you with the relevant products/services, the personal data (including sensitive personal data) set out below is necessary. 2.      In general, we process your personal data with your consent, and where appropriate, with separate consent from you for processing your personal data under specific circumstances required by the applicable data protection laws and regulations in Mainland China. You acknowledge and agree that under the following situations, we are not required to obtain your consent to process your personal data:-

 

(i) the processing is necessary for the conclusion or performance of a contract to which you are a party, or where it is necessary to conduct human resources management according to lawfully formulated labour rules and lawfully concluded collective contracts;

(ii) the processing is necessary for the performance of our duties or obligations under any applicable laws and regulations, including those directly related to:

1.     National security and national defence;
2.     Criminal investigation, prosecution and trial and execution of court orders, judgments or related matters; or
3.     Public security, public health, or major public interest;

(iii) the processing is necessary for responding to public health emergencies, or for the protection of life, health and property safety of natural persons under emergency circumstances;

(iv) the personal data is processed within a reasonable scope to conduct news reporting, supervision by public opinion and other activities in the public interest;

(v) the personal data is made available to the public by you or the personal data about you from legitimate public sources is processed within a reasonable scope in accordance with the laws and regulations; or

(vi) other circumstances as provided by the laws and regulations.

 

4. Your rights as the personal data subject

 

1.      Please refer to Clause 15 of the Privacy Policy Statement in relation to your rights to access, correct your personal data and withdraw your consent. Further, in accordance with the applicable data protection laws and regulations in Mainland China, we will ensure that you may exercise the following rights over your personal data, including:-

 

1.      You may request to delete your personal data if:-

 

（1）our processing of your personal data breaches laws or regulations;

（2）we collect or use your personal data without your consent;

（3）our processing of your personal data breaches our agreement with you;

（4）you no longer use our products and/ or services, or the purposes described in Clause 3 of this Addendum have been achieved or accomplished;

（5）you withdraw your consent;

（6）we no longer provide products and/or services to you;

 

2.      Change the scope of your consent;
3.      Obtain a copy of your personal data; or
4.      Request to transfer your personal data to another personal data processor provided that such request is compliant with the applicable laws and regulations.

 

2.      Such requests shall be made to the Personal Data Privacy Officer of NWD via the contact details set out in Clause 19 of the Privacy Policy Statement (mailing address: 30th Floor, New World Tower, 18 Queen's Road Central, HKSAR). We will endeavour to reply to your reasonable requests in relation to the above within fifteen (15) PRC working days from the day we receive your request.

 

3.      However, please note we may refuse your requests under the following circumstances:-

 

1.      Circumstances relevant to the fulfilment of our obligations under laws and regulations, including our provision of your personal data (including your sensitive personal data) generated during the transaction between you and us to the regulatory authority(ies) and or other governmental departments under the laws and regulations of Mainland China;
2.      The data retention period required by any law or administrative regulation has not expired, or it is difficult to delete personal data technically (in such cases, we will take necessary security protection measures to ensure the security of your personal data or anonymize such personal data);
3.      Circumstances directly related to national security and defence security;
4.      Circumstances directly related to public security, public health, or significant public interest;
5.      Circumstances directly related to criminal investigation, prosecution and trial, and execution of court decision;
6.        Circumstances where we have sufficient evidence to prove that you have subjective malice, or you are abusing your rights;
7.      Circumstances where protection of your or other individual’s life, property and other important lawful rights is involved;
8.      Circumstances where responding to your request will cause serious harm to the lawful rights and interests of you or other individuals or organisations (including us); or
9.         Circumstances where trade secrets are involved.

 

5. Retention of personal data

 

Your personal data will be kept by us for no longer than necessary for the fulfillment of the Purposes. Please refer to Clause 8 of the Privacy Policy Statement for further details.

 

6. How we entrust others to process, share, transfer and publicly disclose your personal data

 

1.      To achieve the Purposes under Clause 3 of this Addendum, you understand and agree that we may entrust the processing of your personal data (including sensitive personal data) to third party service providers as set out in Clauses 9 and 11 in the Privacy Policy Statement.

 

2.      The third party service providers entrusted by us have no authority to use your personal data for any other purposes. If there is any change to the purpose of processing of your personal data, we will ask for your consent again.

 

3.      Your personal data may also be shared with the New World Group and joint venture companies together referred to as “Affiliates” and our “Marketing Partners” located within or outside Hong Kong, which include property developers, banks, financial and investment institutions, insurance companies, private clubs, concierge and customer service providers, retail outlets and online businesses (products and services including fashion and beauty, health and personal cares, luxury, home and living, food, wine, and beverage, books and stationery), shopping malls, loyalty programmes, department stores, watches and jewellers (such as Chow Tai Fook Jewellery Group Limited), hotel chains, catering service providers, healthcare and senior care, services and/or products providers including health and wellness, art and culture, gallery and exhibition, green and nature, sports and recreation, travel and accommodation, leisure and entertainment, transportation and logistics, telecommunication, media and information technology, corporate innovation, accelerator and incubation programmes, competitions, conferences and events, pre-school, primary, secondary and/or tertiary education institutions etc., the details of which are set out in Index 1 of this Addendum.

 

7. How we store and transfer your personal data

 

In principle, we collect, produce and process the personal information in the PRC in accordance with the business purposes set out in Clause 3 of this Addendum and they will be stored in the Hong Kong, China. You understand, authorise and consent that we may transfer your personal information outside Mainland China to our headquarters in Hong Kong, Affiliates, Marketing Partners and other entities outside Mainland China (please refer to Index 2 of this Addendum for further details), and to the servers and/or data centres in Mainland China and Hong Kong of our partners, co-operators, agents, contractors, suppliers and service providers whom we have entrusted to process your personal information Click here to enter text. (please refer to Index 3 of this Addendum for further details), may access your personal information from Mainland China and Hong Kong due to business needs and solely for achieving the business purposes set out in Clause 3 of this Addendum and to the maximum extent permitted by law and in accordance with the mandatory requirements under the laws and regulations of the PRC.  Mainland China and Hong Kong have enacted personal information protection laws, and we will also ensure that your personal information is adequately protected in accordance with this Addendum. If you would like to learn more about the storage and cross-border transfer of your personal information, withdraw your consent and/or exercise your other rights in accordance with Clause 4 of this Addendum, please contact us via the means set out in Clause 10 of this Addendum and we will respond to your request to a reasonable extent.

 

We will not transfer your personal data to any company, organisation or individual outside of NWG, its Affiliates and/or Marketing Partners, except under the following circumstances:

 

1.         Transfer with separate consent. After obtaining your separate consent, we will transfer your personal data to other parties in accordance with this Addendum;

 

2.         When we are involved in any actual or proposed transfer of business, transfer of shares, re-structuring, amalgamation, merger, sale, transfer or purchase of us or our business or our Affiliates or our Affiliates' businesses (please refer to Clause 18 of the Privacy Policy Statement);

 

（3） We may otherwise transfer your personal data in accordance with applicable laws and regulations, requirements under legal proceedings, compulsory administrative or judicial requirements.

 

8. How we process minors’ personal data

 

Please refer to Annex A for the rules for processing minors’ personal data. If parents or legal guardian are aware that personal data of any minors aged below eighteen (18) under their care have been provided to us without consent, please notify us immediately to delete such personal data.

 

9. Miscellaneous

 

Further, the following Clauses in the Privacy Policy Statement shall apply:-

 

1.      Clause 4 shall apply in respect of the use of cookies and other tracking mechanisms;
2.      Clause 12 shall apply in respect of the security of personal data;
3.      Clause 13 shall apply in respect of circumstances where NWD excludes liability for disclosure of your personal data, which will be subject to the applicable laws and regulations in Mainland China;
4.      Clause 17 shall apply in respect of the update of this Privacy Policy Statement and this Addendum

11. Inconsistency or conflict

 

If there is any inconsistency or conflict between the English and Chinese versions of this Addendum, the English version shall prevail.

Annex A to the Addendum –

Rules on processing minors’ personal data (hereinafter “Annex A”)

 

1. Application

 

This Annex A provides the rules of the activities of New World Development Company Limited (“NWD”) in processing personal data of persons aged below eighteen (18) who are:-

 

1.                  an individual located in the Mainland China who visits NWD’s relevant website(s) for the Playpark, or otherwise uses or attends the Playpark, NWD’s premises, facilities, events, programmes products and/or services by phone or any other means from Mainland China; and/or
2.                 an individual holding Mainland China passports and/or resident identity cards who visit, uses or attends the Playpark, NWD’s premises, facilities, events, programmes in Hong Kong or otherwise use NWD’s products and/or services by phone or any other means in Hong Kong.

 

(The aforesaid persons aged below eighteen (18) hereinafter referred to as “Minor”, “Minors” or “Minor(s)”.)

 

If you are a Minor, please read the Privacy Policy Statement, the PICS, the Addendum and this Annex A together with your parents or legal guardians and obtain their consent before providing any personal data to us.

 

If you are the parents or legal guardians who would like to provide any personal data of Minor(s) under your care, please ensure that you have carefully read, understood and agreed to the Privacy Policy Statement, the PICS, the Addendum and this Annex A before doing so.

 

In the event of any conflict or inconsistency concerning the processing of Minors’ personal data, they shall be resolved in the following order of precedence (from higher to lower): - (a) this Annex A; (b) the Addendum; (c) the PICS and (d) the Privacy Policy Statement. 

 

2. Personal Data

 

Clause 2 of the Addendum applies, save and except that the “sensitive personal data” involved in this Annex A includes all Minors’ personal data.

 

 

3. How we collect and process Minors’ personal data

 

The following shall apply to how we collect and process Minors’ personal data:-

 

1.   Minors’ personal data shall only be provided to us upon the consent of Minors’ parents or legal guardians. If the Minors’ parents or legal guardians subsequently withdraw the consent, they and the Minors shall immediately cease the provision of their personal data to us.

 

2.   If Minors’ parents or legal guardians become aware that without their consent Minors under their care have provided personal data to us, please notify us to delete them by contacting our Personal Data Privacy Officer via the contact details set out in Clause 10 of the Addendum.

 

3.    Minor’s personal data will be processed by us for the purposes as further specified below only (“Purposes for Minors”). In particular, in order for us to carry out the Purposes for Minors, the personal data set out below is necessary. If such information is not available or not accurate, we may not be able to perform the Purposes for Minors:-

4.   In general, we process Minors’ personal data with their parents or legal guardians’ consent, and where appropriate, with separate consent from you for processing your personal data under specific circumstances required by the applicable data protection laws and regulations in Mainland China. Besides, disclosure of Minors’ personal data as above mentioned will be conducted in accordance with the applicable data protection laws and regulations in Mainland China.

 

4. Minors’ rights as the personal data subjects

 

Clause 4 of the Addendum applies to the extent that you as a Minor, or the parents or legal guardians of the Minor(s), may exercise the Minor(s)’ rights as provided therein. 

 

5. Retention of personal data

 

Clause 5 of the Addendum applies only to the extent for the Purposes for Minors and save and except that Minors’ personal data collected and processed for the purpose of Clause 3 of this Annex A, the Minors’ personal data will not be stored in our systems and shall be deleted once the said purpose has been achieved.

 

In addition, we strictly control the access to Minors’ personal data and only allow authorised personnel that are strictly necessary to process Minors’ personal data to access such data. 

 

6. How we entrust others to process, share, transfer of Minors’ personal data

 

1.   To achieve the Purposes for Minors under Clause 3 of this Annex A, we may entrust the processing Minors’ personal data (including sensitive personal data) to agents, contractors, third party vendor, suppliers, public and governmental authorities, professional advisors and/or service providers as set out in the PICS only to the extent necessary for the performance of the Purposes for Minors, including but not limited to identity verification.

 

2.   The agents, contractors, third party vendors, suppliers and/or service providers and other entities entrusted by us have no authority to use Minors’ personal data for any other purposes. If there is any change to the purpose of processing of Minors’ personal data, we will ask for your consent again.

 

3.   There is no sharing of Minors’ personal data.

 

 

7. How we store and transfer Minors’ personal data

 

 

No Minors’ personal data will be stored after the Playpark and transferred to any third party.
